Why should QDROs be pre-approved by the Plan Administrator before filing with the Court?

In order for a QDRO to be Qualified it must be approved by the Plan Administrator as to form and content. There are some very specific legal requirements provided by law in order for a Domestic Relations Order to be Qualified. In addition, many Plan Administrators require specific language or substantive provisions be included, above and beyond those required by law. QDRO Pros will obtain these pre-approvals on all applicable QDROs. As experts in QDRO law we can negotiate changes with the Plan Administrator from Model language that accurately reflects the settlement the parties agreed to. In addition, some courts require that the QDRO be pre-approved by the Plan Administrator before the judge will sign the QDRO.
